WHAT IS A TRADEMARK?
A trademark contains you brand name, slogans and logos, which allow to identify a specific product or group of products, OR services. A registered trademark is an asset of your business. With its help, you can not only clear the market of counterfeits or prohibit the import of counterfeit goods, but also use it as a springboard for the development and expansion of your business by transferring rights through franchises and licenses.

HOW DO YOU OBTAIN A TRADEMARK?

  • If you reside in the United States, you are allowed to apply yourself, but check out the first paragraph of this article and decide whether you are ready for the paperwork overload.
WHAT DO I NEED TO HAVE?
  1. You need search through the USPTO database and check, whether a similar mark is already registered or whether a pending application for a confusingly similar mark has been filed, for related goods and/or services. 
  • OR, you can simply provide your attorney with your preferred brand names;
 
  1. You need to examine the Acceptable Identification of Goods and Services Manual at the USPTO to identify your goods/services and to choose a mark format.
  • Or, simply inform your attorney about the type of products you wish to register;
 
  1. You need to provide a Statement of Use with “specimen”, which shows the way you use the mark in the commerce, in connection with your goods and services.
    This is an obligatory step during the process of submitting your application.
  • You will only need to send an attorney the screenshots or photos/videos of the trademark in use.
 
HOW LONG DOES IT TAKE?
The usual turnaround time for Registration Approval is around 10 months, if all documents were submitted in the proper condition, and no objections arise.
